As a blogger, what do you do if you see a post or an article that you really want use when you write about the same subject? Do you copy part of the post, try to summarize it as best you can, simply put a link to the post?
There are some gray areas when it comes to what is considered "fair use," and simply a lack of litigation on the matter leaves a lot still up for speculation among the working class.
One of the best resources I've found on the matter is on the Moz Blog (Technorati Top 100 in Business, Small Business and Infotech), written by Sarah Bird.
The post What's Fair About Fair Use? Defending a Copyright Infringement Claim offers a description of what fair use is, how it relates to trademark, copyright and patent law, as well as factors to consider when you are trying to determine if you are using published material as fair use or if you're infringing on someone's rights.
Check out the post, as it is a good resource to make sure you're getting the most out of fair use tactics without going too far.
