For those who remember just how much of a pain it was to install iOS 8, you may experience a small form of victory in the new year. On Tuesday, a class action lawsuit was filed in San Francisco’s Federal Court against Apple, claiming that the iOS 8 update takes up more space than is advertised. The suit also asserts that consumers weren’t made aware of just how much space the mobile operating system can take up.


From the lawsuit, the Washington D.C-based law firm, Cuneo Gilbert & Laduca, is seeking damages and will attempt to make Apple will change its policies.


Lawyers say that not only did Apple mislead consumers about how much space they would have once they updated, or when they purchased a device with iOS 8 already installed, they also tried to push the consumers into purchasing more storage through iCloud when in a pinch for space, such as during weddings or at a child’s recital.


Though Apple did call iOS 8 the biggest release ever, the lawsuit alleges that consumers were never given notice of just how much space that would actually mean. Siliconbeat reports that as much as 23.1 percent of the overall phone’s storage can be taken up by the iOS.


iOS 8 has already been bogged down by bugs and a long download time. Since then, there have been several updates to address the bugs as well as to incorporate services like ApplePay and Health, but not all users have updated. Currently, a page meant for software developers shows that 64 percent of all Apple devices are running on iOS 8. However, that figure does take into account that some older devices are not compatible with the update.
